By accessing or using InmateTelefone's website and services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
Description of Service
InmateTelefone provides paid plans for text messaging, photo sharing, and related communication services between you and an incarcerated individual, subject to the rules and policies of the relevant correctional facility.
Eligibility
You must be at least 18 years old to purchase a plan or use our services.
Account & Payment
When you purchase a plan, your payment is applied to the specific inmate account associated with the inmate ID number you provide. It is your responsibility to enter the correct inmate ID number. We are not responsible for credits applied to an incorrect account due to inaccurate information you provide.
All prices are listed in U.S. Dollars. Plans are generally non-refundable once services have been credited to an account, except where required by law.
Acceptable Use
You agree not to use our services to send unlawful, threatening, abusive, or harassing content, or to violate any facility, state, or federal rule governing inmate communication. All facility rules and regulations continue to apply to any communication sent through our services, and messages may be monitored or reviewed by facility staff as permitted by applicable policy.
Service Availability
We work to keep our services available and reliable, but we do not guarantee uninterrupted access. Delivery of messages, photos, and calls can be affected by factors outside our control, including facility phone/mail systems and mobile carrier networks.
SMS Messaging Terms
Use of our SMS messaging service is subject to the terms on our SMS Opt-In, including message frequency, opt-out (STOP), and help (HELP) instructions.
Limitation of Liability
To the maximum extent permitted by law, InmateTelefone is not liable for any indirect, incidental, or consequential damages arising from your use of our services.
Changes to These Terms
We may update these Terms of Service from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
Governing Law
These Terms are governed by the laws of the United States and the state in which InmateTelefone operates, without regard to conflict-of-law principles.
